1. Acceptance of Terms
By accessing and using RotaryTuner ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
These terms apply to:
- Our website (rotarytuner.com)
- Our account, community, garage, marketplace, shop, support, and AI features
- Any related content, tools, APIs, communications, or functionality we provide
2. Use License
We grant you a limited, non-exclusive, non-transferable license to access and use RotaryTuner for personal use, community participation, permitted marketplace activity, and shop purchases. You may not:
- Reproduce, duplicate, copy, or sell any portion of the Service
- Scrape, crawl, or use bots to extract data from the platform
- Reverse-engineer or attempt to access our source code
- Resell access or your subscription to others
- Use automated tools to abuse query limits or resources
- Harass, threaten, or abuse other users in the community
- Use the Service to train, benchmark, or operate competing AI or data products without written permission
Violation of these restrictions may result in suspension or termination of your account.
3. Your Account
Registration & Responsibility:
- You're responsible for maintaining the confidentiality of your password
- You agree not to share your account credentials
- You're liable for all activity under your account
- You must be at least 13 years old to use RotaryTuner
- If you are under 18, you may use RotaryTuner only with permission from a parent or legal guardian
- You must be 18 or have permission from a parent or legal guardian to make purchases, start a paid trial, subscribe, list marketplace items, or enter into transactions
- Notify us immediately of unauthorized access through the support flow or feedback tool
Accurate Information:
- You agree to provide truthful, accurate information during registration
- You're responsible for keeping your profile information up to date
- False or misleading information may result in account termination
4. Subscription Terms
4.1 Paid Subscriptions
Billing:
- Paid subscriptions may be billed monthly or annually, depending on the plan and billing period you select
- You'll be charged at the start of each paid billing cycle, except during an active trial period
- Charges will appear on your credit card or payment method on file
- Prices are in USD and may be subject to change with 30 days notice
Auto-Renewal:
- Your subscription automatically renews unless you cancel before the renewal date
- You authorize us to charge your payment method on the renewal date
- If a charge fails, we'll attempt to retry with the payment method on file
Cancellation:
- You can cancel your subscription anytime through your account settings
- Cancellation takes effect at the end of your current billing cycle
- No refunds for partial billing periods or unused time unless required by law
- You'll retain access until the end of your paid period
Refunds:
- Subscriptions are non-refundable
- If you believe a charge is erroneous, contact us through the support flow within 30 days

- Community, build profile, marketplace browsing, and shop access remain available separately on the free Community tier

- Extended AI access and priority AI handling where available
- Advanced diagnostics features where available
Crew ($39.99/month or $399.90/year)
- 4,800 AI chat queries per month
- All Pro features
- Maximum AI access currently offered
- Early access, creator, or showcase features where available
Plan names, prices, query allowances, and features may change. The current pricing page and Stripe checkout terms control the plan you select at signup or upgrade.
5. Trial Terms
7-Day Free Trial:
- Payment method required — A valid credit or debit card is required to start your free trial. Your card will not be charged during the 7-day trial period.
- Daily query limit — Trial accounts are limited to 20 AI queries per day. This limit resets daily.
- One trial per card — Each payment card may only be used for one free trial. Attempts to create multiple trial accounts using the same card will be declined.
- Auto-renewal — Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan at the price of the plan you selected at signup. Your card will be charged at that time.
- Cancel anytime — You may cancel your trial at any time before the 7-day period ends through your account settings or the Stripe billing portal. No charge will be applied if cancelled before the trial expires.
- Usage controls — Trial and paid accounts may be subject to short-term rate limits to protect the Service from abuse, automation, credential compromise, or excessive load.
5A. AI Usage Limits and Abuse Controls
AI features consume third-party computing resources. To keep the Service reliable and protect accounts from unauthorized or automated usage, we may enforce monthly limits, daily limits, short-window rate limits, image limits, message length limits, and temporary service-wide cost controls.
- Usage limits may vary by subscription tier, trial status, feature, model, and account risk signals
- Short-window limits may apply even if you have monthly queries remaining
- We may throttle, reject, or temporarily suspend AI requests that appear automated, abusive, compromised, or unusually expensive
- We may adjust abuse-prevention limits without advance notice when needed to protect the Service or your account
- Published monthly query allowances are not a guarantee of uninterrupted or unlimited burst usage
We may record AI request metadata, rate-limit events, token estimates, model usage, and service-cost information to operate these controls and protect the Service.
6. AI Disclaimer
6.1 Informational Use Only
RotaryTuner's AI assistant provides informational and educational content only. It is NOT a substitute for professional mechanical advice, engineering consultation, or professional automotive service.
6.2 No Warranty or Liability
The AI responses:
- May contain errors, inaccuracies, or outdated information
- Should NOT be relied upon for safety-critical decisions
- Should be reviewed by a qualified professional before implementation
RotaryTuner is NOT responsible for:
- Engine damage or mechanical failure resulting from AI recommendations
- Incorrect parts installations based on AI suggestions
- Financial loss from following AI advice
- Performance issues or safety hazards caused by user implementation
- Voided warranties or manufacturer disclaimers
6.3 User Responsibility
You assume full responsibility for:
- Verifying all AI recommendations with professional mechanics or manufacturers
- Following proper installation procedures and safety guidelines
- Checking manufacturer specifications and compatibility
- Understanding that rotary engine modifications are complex and risky
If you are not a qualified mechanic, DO NOT attempt significant modifications without professional oversight.
8. User Content & Build Profiles
Ownership:
- You own all build profiles, photos, and chat history you create
- You retain the right to delete or export your content anytime
License to RotaryTuner:
By posting, uploading, submitting, or sharing content, you grant RotaryTuner a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, crop, format, display, publish, distribute, transmit, moderate, remove, back up, and otherwise use that content as needed to operate, secure, support, and promote the Service.
- Display your build profile in our community car showcase (unless marked private)
- Display public posts, comments, listings, photos, build pages, and profile content to other users
- Create technical copies, thumbnails, previews, backups, and cached versions
- Share content with service providers as needed for hosting, storage, security, analytics, AI, moderation, support, and email delivery
- Use aggregated or de-identified information to improve features, recommendations, safety systems, and AI behavior
Public content can be viewed, copied, indexed, screenshotted, cached, or shared by other users and third parties. Deleting content from RotaryTuner may not remove copies outside our control.
Community Guidelines:
- Build profiles in the public showcase must be appropriate and non-offensive
- General profanity is allowed, but profanity used to harass, threaten, abuse, sexually harass, or attack another person is not allowed
- No hate speech, slurs, protected-class attacks, harassment, credible threats, self-harm encouragement, doxxing, or blackmail
- No pornography, nudity, sexual acts, sexualized images, sexual solicitation, or sexually explicit profile, build, marketplace, message, or community images
- Any sexual content involving minors, real or fictional, is strictly prohibited and may result in account termination and reporting where legally required
- No spam, unauthorized commercial promotion, fake engagement, fraudulent offers, or misleading information
- RotaryTuner may scan posts, comments, messages, profile fields, captions, listings, and uploaded images before or after publication to enforce these guidelines
- RotaryTuner may block, remove, restrict, or hold content for review and may warn, suspend, or terminate accounts that violate these guidelines
7A. Privacy, Analytics, and AI Data
Our Privacy Policy explains how we collect and use information, including account data, build profiles, chat history, saved AI memory, billing records, shop order information, saved shipping addresses, operational logs, and analytics.
We use privacy-focused product analytics and operational logging to understand traffic, improve features, debug issues, measure performance, detect abuse, and operate paid AI resources. You agree not to place sensitive personal information in public profile fields, URLs, listing titles, comments, or other places where it may be visible to other users or processed as log or analytics data.
AI prompts and related context may be processed by third-party AI providers to generate responses. Do not submit payment card numbers, government IDs, medical information, or other sensitive data unless it is necessary for your request and you accept the risk.
Safety and moderation systems may process user-generated text, uploaded images, captions, comments, messages, and related metadata to detect prohibited content, abuse, spam, threats, sexual content, and other policy violations.
9. Marketplace — Third-Party Transactions
8.1 Platform Only
RotaryTuner operates a peer-to-peer marketplace that allows users to list and discover automotive parts, accessories, and related items. RotaryTuner is a platform provider only. We are not a buyer, seller, broker, or agent in any transaction. All transactions are solely between the buyer and the seller. We do not process peer-to-peer marketplace payments, escrow funds, inspect items, ship items, or guarantee either party's performance unless a feature expressly says otherwise.
8.2 No Warranty on Listings
RotaryTuner makes no representations or warranties regarding the accuracy, completeness, safety, legality, or condition of any listed item. We do not inspect, verify, or authenticate listings.
8.3 Buyer and Seller Responsibility
Users who buy or sell through the marketplace do so at their own risk. Buyers are responsible for independently verifying item condition, legality, and suitability. Sellers are responsible for accurate descriptions, lawful ownership, lawful sale, safe packaging, shipping arrangements, and honoring stated terms. Buyers and sellers are responsible for complying with emissions, safety, import/export, tax, shipping, hazardous-material, and vehicle-equipment laws that apply to them. Because RotaryTuner does not process peer-to-peer marketplace payments, RotaryTuner does not issue tax forms such as Form 1099-K for those marketplace transactions; sellers are responsible for their own tax reporting obligations.
8.4 Prohibited Listings
The following are prohibited on the marketplace:
- Stolen or fraudulently obtained parts
- Items that are illegal to sell or possess in the buyer's or seller's jurisdiction
- Counterfeit or misrepresented items
- Items with falsified mileage, condition, or specifications
- Emissions defeat devices, illegal street-use parts, or products advertised for unlawful road use
- Airbags, SRS components, explosives, hazardous materials, fluids, or batteries unless lawful and safely shippable
- Recalled, unsafe, tampered, or title/VIN-related items that may create legal or safety risk
- Weapons, controlled substances, malware, stolen credentials, or non-automotive illegal goods
- Any item prohibited by applicable law
8.5 Reporting and Removal
RotaryTuner reserves the right to remove any listing at our sole discretion, with or without notice. Users may report problematic listings using the in-app reporting tool. We are not obligated to act on any report but will review reports in good faith.
8.6 Disputes
RotaryTuner does not mediate disputes between buyers and sellers. We are not liable for any loss, damage, or harm arising from marketplace transactions. Users agree to resolve disputes directly with each other or through applicable legal channels.
8.7 Release
To the fullest extent permitted by law, you release RotaryTuner, its officers, employees, agents, and successors from any claims, demands, or damages arising out of or in any way connected with a dispute with another user in connection with the marketplace.
8A. Shop, Merchandise, Shipping, and Fulfillment
RotaryTuner may sell merchandise, apparel, accessories, or other goods through the Service. Shop orders may be produced, shipped, or fulfilled by third-party providers such as Printify and their production partners.
- You are responsible for providing accurate shipping and contact information before checkout
- Shipping estimates, delivery windows, taxes, and availability may change and may depend on third-party providers
- If you choose to save your shipping address, we may store it in your account for future checkout until you remove it or delete your account, subject to legal retention needs
- Order, payment, tax, fulfillment, shipping, and chargeback records may be retained as business records even after account deletion
- We may reject, cancel, or refund orders affected by pricing errors, inventory issues, fraud signals, payment failure, shipping restrictions, or fulfillment-provider problems
- Merchandise colors, placement, sizing, and availability may vary due to production, screen, and fulfillment-provider differences
- Returns, replacements, or refunds may be limited for made-to-order, custom, worn, damaged, or incorrectly addressed items unless required by law
For order or merchandise issues, use the in-app Report a Problem form and select "Order Issue".
10. Acceptable Use Policy
You agree not to:
- Harass, threaten, abuse, or defame other users
- Post or upload pornography, nudity, sexual content, sexual solicitation, or sexually explicit images
- Post or upload any sexual content involving minors
- Post private personal information about another person without permission
- Post spam, phishing links, or malware
- Post fraudulent marketplace listings, fake reviews, fake engagement, or deceptive endorsements
- Post unlawful street-racing coordination, instructions to evade law enforcement, or content encouraging dangerous illegal driving
- Attempt to hack, crack, or gain unauthorized access
- Overload our servers or disrupt the Service
- Violate any local, state, or federal laws
- Infringe on intellectual property rights
- Scrape, crawl, or extract data via bots
- Resell or distribute access to the Service
- Abuse query limits (e.g., excessive requests to game free trial limits)
Marketplace listings, shop purchases, future approved sponsorship/referral features, and other commercial activity expressly supported by RotaryTuner features are allowed when used honestly and lawfully.
Violations may result in immediate account suspension or termination.
11. Intellectual Property
Our Content:
- All trademarks, logos, and platform design are owned by RotaryTuner or our licensors
- You may not reproduce, distribute, or use our IP without permission
Third-Party Content:
- Some content comes from third parties (e.g., AI models from Anthropic/OpenAI, payment processors, fulfillment providers, and linked external sites)
- These are licensed and may have separate terms
Copyright Complaints and Repeat Infringers:
If you believe content on RotaryTuner infringes your copyright, send a notice that includes: your physical or electronic signature, identification of the copyrighted work, identification of the allegedly infringing material and where it appears, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.
If your content was removed because of a copyright complaint, you may send a counter-notification with the information required by the Digital Millennium Copyright Act. We may restore content when legally permitted. We may terminate or restrict accounts of repeat infringers where appropriate.
Copyright notices and counter-notices may be sent through the Report a Problem form when available or the site feedback tool. RotaryTuner should register and maintain a designated DMCA agent with the U.S. Copyright Office before relying on DMCA safe-harbor protection.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- RotaryTuner is provided "AS IS" without warranties, express or implied
- We do NOT warrant that the Service will be uninterrupted, error-free, or secure
- We do NOT warrant user content, public build information, marketplace listings, third-party links, AI output, product availability, shipping estimates, or third-party services
- We are NOT liable for indirect, incidental, special, or consequential damages
- Our liability is limited to the amount you paid in the last 12 months
Exceptions:
- We remain liable for gross negligence, fraud, or violation of law
- This limitation does not apply to personal injury or death
13. Indemnification
You agree to indemnify and hold harmless RotaryTuner, its owners, employees, and partners from any claims, damages, or costs (including legal fees) arising from:
- Your use of the Service
- Your violation of these terms
- Your user content or build profiles
- Your infringement of third-party rights
- Engine damage or vehicle issues from following AI recommendations
- Your marketplace listings, purchases, sales, shipping, taxes, disputes, or legal compliance failures
14. Termination
By You:
- You can close your account anytime through account settings
- Data will be deleted or retained as described in our Privacy Policy
By Us:
We may suspend or terminate your account for:
- Violation of these terms
- Illegal activity
- Non-payment of subscription fees (after 30-day notice)
- Abuse of the Service
- Fraud, chargebacks, security risk, prohibited content, or conduct that may expose RotaryTuner or users to legal or safety risk
Termination is effective immediately upon notice. No refunds will be issued.
15. Governing Law & Dispute Resolution
Governing Law:
These Terms are governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles.
Jurisdiction:
- You agree to submit to the exclusive jurisdiction of the state and federal courts located in Hawaii
- You waive any objection to venue in these courts
Dispute Resolution:
- Before filing suit, you agree to attempt good-faith resolution through the support flow or feedback tool
- If informal resolution fails, you may pursue legal action
14A. Class Actions and Arbitration
To the extent permitted by law, disputes must be brought only on an individual basis and not as a plaintiff or class member in a class, consolidated, or representative action. Before filing a claim, you agree to contact us and attempt informal resolution.
RotaryTuner may add a binding arbitration program with a 30-day opt-out period in a future update. Until then, the Hawaii court provisions above apply.
16. Modifications to Terms
We may update these Terms at any time. Material changes will be posted here with a new effective date. Your continued use of RotaryTuner after changes indicates acceptance of the new terms.
17. Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
